1. Scope
These Terms of Use govern access to and use of the FailFast EDU website (failfastedu.com) and the FailFast EDU school learning platform, both operated by FAILFAST PIONEER SYSTEMS LTD (RC: 9433743), a company incorporated in Nigeria with its registered address at 6, Rotimi Street, Yaba, Lagos, Nigeria.
FailFast EDU is a school-only learning environment. These terms do not apply to any other product operated by FAILFAST PIONEER SYSTEMS LTD. There are no deposits, withdrawals, financial transactions, prizes, or money-based competition features in this service.
By accessing the website, joining the waitlist, or using the platform, you agree to these terms. If you are a School Admin accepting on behalf of a school, you represent that you have the authority to bind the school to these terms.
2. Who Can Use FailFast EDU
FailFast EDU is available to:
- Secondary schools and tutorial centers of any size, based in Nigeria or internationally.
- School admins who are authorized to manage the school's account. The admin must be an adult (18 or older).
- Teachers who are assigned to a school account by a school admin.
- Students who are enrolled in a school account by a school admin or teacher. Students may be any age.
- Website visitors who wish to learn about the platform or join the school waitlist.
3. Account Types and School Authority
FailFast EDU has four account types:
- School Admin: Controls the school environment. Can create, edit, and deactivate teacher and student accounts. Manages billing. Approves inter-school features.
- Teacher: Creates quizzes and practice sessions, sets class difficulty, reviews student progress. Cannot manage billing or access another teacher's accounts.
- Student: Practices with assigned subjects, earns Grit Points and Success Points, reviews their own progress. Cannot access another student's data.
- Website visitor: May use the public website and submit the school waitlist form.
The School Admin is responsible for the conduct of all accounts they create. If a school admin creates a student account for a minor, the school is responsible for ensuring appropriate consent and oversight.
4. Account Security
You are responsible for keeping your login credentials secure. Do not share your password with others. If you believe your account has been compromised, contact us immediately at legal@failfastedu.com.
FAILFAST PIONEER SYSTEMS LTD is not liable for losses resulting from unauthorized access caused by your failure to keep credentials secure.
5. Teacher-Created Content
Teachers may create custom quizzes and practice content within their school environment. By creating content on the platform, you grant FAILFAST PIONEER SYSTEMS LTD a limited license to store and display that content to users within your school.
You must not create content that:
- Infringes on the copyright or intellectual property rights of others
- Contains offensive, abusive, or discriminatory material
- Promotes any commercial product or service outside FailFast EDU
- Violates any applicable law
FAILFAST PIONEER SYSTEMS LTD may use teacher-created questions (without personally identifying information) to improve and grow the platform question bank, with the agreement of the school admin.
6. Student Conduct
Students must use the platform honestly and in accordance with their school's instructions. Students must not:
- Attempt to access another student's account or data
- Use automated tools or scripts to answer questions or manipulate scores
- Interfere with the platform or other users' experience
- Submit false information to the platform
Schools are responsible for enforcing conduct standards for their students. FAILFAST PIONEER SYSTEMS LTD may suspend or restrict a student account if abuse is detected, and will notify the school admin.
7. Scoring and Progress
FailFast EDU uses a fail-forward scoring model. Each question allows up to three attempts. Correct answers earn Success Points. Wrong attempts that lead to a correct answer earn Grit Points. Students who do not answer correctly on any attempt still earn Grit Points for persistence.
Success Points drive subject tier progression (Rookie, Skilled, Expert, Master, Grand Master). Grit Points appear on school analytics and reflect effort, not just accuracy.
Scores, points, and tier rankings are final as recorded by the platform. There is no mechanism for manual point adjustment by teachers or admins. If you believe there is a technical error in scoring, contact us at legal@failfastedu.com.
Scores and points in FailFast EDU have no monetary value. They cannot be exchanged for money, prizes, or any other reward outside the school learning environment.
8. School Dashboards and Analytics
School admin and teacher dashboards show aggregated and individual student progress data. This data is available only to authorized users within the same school. Schools are responsible for how they use this data in their internal operations (e.g. parent reports, academic decisions).
FAILFAST PIONEER SYSTEMS LTD does not use student analytics data to make automated decisions about individual students with legal or significant effects. All data-driven decisions about student outcomes remain the responsibility of the school.
9. Billing and Free Allocation
Every school account includes a free allocation of 1 admin, 2 teachers, and 6 student accounts. Accounts within the free allocation are not charged.
Accounts above the free allocation are billed based on account-days: the number of calendar days each account was active during the term. Billing is calculated at the end of each school term. An account active for half a term is charged at half the full-term rate.
Current launch pricing (Nigerian billing): Admin — 3,000 naira per term. Teacher — 2,000 naira per term. Student — 1,000 naira per term.
Pricing is subject to change. Schools will be notified at least 30 days before any price increase takes effect. The school admin is responsible for ensuring billing contact information is accurate.
All payments are processed in naira for Nigerian schools. International schools will be invoiced in a mutually agreed currency at onboarding.
10. Pilot Schools
Partner schools accepted into the FailFast EDU pilot program receive 3 months of full platform access at no cost, with unlimited admin, teacher, and student accounts. The pilot program is limited to 10 schools. Pilot spots are available to secondary schools with 50 or more students.
In exchange for pilot access, partner schools agree to:
- Provide structured feedback on the teacher and student experience
- Allow FAILFAST PIONEER SYSTEMS LTD to collect anonymized usage and progress data for platform improvement
- Allow teacher-generated questions to be included in the broader question bank (with admin approval)
- Permit FAILFAST PIONEER SYSTEMS LTD to reference the school's participation and outcomes in a public case study (with explicit written consent from the school admin)
After the free period ends, pilot schools transition to standard billing with a 20% discount on the first paid term. The school admin will be notified at least 30 days before billing begins.
11. Acceptable Use
You must not use FailFast EDU to:
- Reverse engineer, decompile, or copy any part of the platform
- Attempt to gain unauthorized access to any account, system, or network
- Upload malware, viruses, or any harmful code
- Use the platform to harvest data from other users
- Engage in any activity that violates Nigerian law or the laws of your country
- Impersonate another user, school, or organization
FAILFAST PIONEER SYSTEMS LTD reserves the right to suspend or terminate any account that violates these rules, at our sole discretion.
12. Intellectual Property
The FailFast EDU platform, design, question bank, software, branding, and original content are the intellectual property of FAILFAST PIONEER SYSTEMS LTD. You may not copy, reproduce, or distribute any part of the platform without our written permission.
Teacher-created quiz content remains the intellectual property of the teacher or school. By uploading content to FailFast EDU, you grant FAILFAST PIONEER SYSTEMS LTD a limited license to display, store, and (with admin permission) use that content within the platform.
13. Account Suspension and Termination
FAILFAST PIONEER SYSTEMS LTD may suspend or terminate accounts that breach these terms, pose a security risk, or are inactive for 12 months or more. We will give reasonable notice where possible.
A school admin may close their school account at any time by contacting us. On account closure, we will provide a data export for the school's records before deleting data (subject to the retention policy in the Privacy Policy).
14. Limitation of Liability
FailFast EDU is provided on an "as is" basis. FAILFAST PIONEER SYSTEMS LTD does not guarantee that the platform will be available at all times, free of errors, or suitable for any specific educational outcome.
To the maximum extent permitted by Nigerian law, FAILFAST PIONEER SYSTEMS LTD is not liable for indirect, incidental, or consequential damages arising from your use of the platform. Our total liability to any school for direct damages shall not exceed the amount paid by that school in the 3 months preceding the claim.
Nothing in these terms limits liability for death, personal injury, fraud, or any liability that cannot be excluded by law.
15. Governing Law
These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these terms shall be resolved in the courts of Nigeria.
If any part of these terms is found to be invalid or unenforceable, the remaining terms continue in full force.
